Но поскольку условия генерального подряда законом не запрещены, договоры подобного типа заключаются повсеместно. Трудовые договоры по своим юридическим характеристикам мало чем отличаются от гражданско-правовых договоров, поскольку в основе трудового договора лежит всё то же свободное волеизъявление сторон.

    Договор, как свободное волеизъявление сторон

    Но сфера применения трудового договора выходит за рамки гражданского права и подпадает под действие трудового права. Под публичными договорами понимаются двухсторонние и многосторонние сделки, заключенные на основании публичной оферты. Договор, как документ — это основной способ оформления правоотношений в сфере гражданского оборота. По своей юридической природе договор — это сделка, заключенная между двумя или более участниками правоотношения. Сторонами таких документов могут выступать лица с различным правовым статусом — юридические лица, физлица, индивидуальные предприниматели, различные государственные и международные организации. Это позволяет создать сотни вариантов одного и того же документа за счет включения различных условий и их комбинаций. В итоге можно составить договор или локальный нормативный акт организации с учетом конкретной ситуации.
